How does CRA know if you sold a house? The CRA does not describe automatically matching every provincial land-title transfer against tax, banking, or mortgage records. It has confirmed that it can use court-authorized unnamed persons requirements to obtain information from developers and builders about buyers involved in assignment sales. That does not establish that every property transfer becomes visible to the CRA.

How Does the CRA Know If You Sold a House? The Detection Channels

A few sources feed the CRA’s cross-checks:

CRA describes court-authorized information requests to developers and builders about buyers involved in assignment sales, followed by compliance checks. That example does not prove automatic matching of every land transfer or that an address change triggers a property audit. CRA: unnamed persons requirements in real estate.

The CRA’s published material confirms requests to developers and builders for assignment-sale buyer information as a third-party data channel. Sellers remain responsible for reporting a sale when tax rules require it; the available information does not establish a standard real-estate T-slip sent by a realtor or lawyer for every sale.

Do You Have to Report a House Sale Even If You Owe No Tax?

If you sell a property that was your principal residence, report the disposition on Schedule 3 and complete Form T2091(IND) to designate it when required; from the 2016 tax year onward, the CRA allows the principal residence exemption only if the disposition and designation are reported. Other sales follow the rules for their tax treatment: for example, business income from a flipped property is reported on Form T2125. A sale with no tax owing may still have a reporting requirement.

If a Canadian housing unit or right to acquire one was held for fewer than 365 consecutive days, a gain can be deemed business income under the residential property flipping rule, subject to exceptions for specified life events and rules for property already held as inventory. The principal residence exemption generally cannot shelter a gain deemed to be business income under that rule. Check the circumstances and the CRA guidance on flipped property.

Québec residents also have provincial income-tax reporting obligations. Check Revenu Québec’s current forms and instructions for your situation in addition to the federal reporting requirements.

Does a House Sale Go on Your GST/HST Return?

For a freelancer or small-business owner, no — not for an ordinary, personal, used home. The sale of a previously occupied residential complex is generally exempt when the seller is not a builder, but tax treatment depends on the seller and property under the GST/HST rules; for example, many builder sales of new or substantially renovated residential complexes are taxable, subject to exceptions, and ITCs on the last acquisition or improvements can affect an exemption. Short-term accommodation has separate GST/HST rules, so its use alone does not determine whether the eventual sale is taxable. CRA home-construction guidance.

A home-office deduction and the principal-residence exemption are separate questions. Whether the entire property qualifies on sale depends on the actual use, changes in use and other CRA conditions, including whether capital cost allowance was claimed. CRA principal residence guidance.

If You Didn’t Report a Sale, Fix It Before CRA Does

If you missed reporting a sale, check the applicable income-tax reporting and reassessment rules and correct the return. An unreported disposition may permit reassessment beyond the normal period under specific rules; a penalty is not automatic. If you need to request relief, review CRA’s conditions for the Voluntary Disclosures Program. CRA principal residence guidance.

  • If it was a straightforward principal-residence sale with no tax owing and no CRA contact yet, use Change My Return in CRA My Account, or file a paper T1-ADJ, to add the missing Schedule 3 and T2091.
  • If real tax is at stake — a flip, a rental, or unreported gains over multiple years — eligibility and relief under the Voluntary Disclosures Program (VDP) depend on whether your application is unprompted or prompted and whether you are under audit or investigation. The CRA may grant relief from penalties and interest, but tax owing remains payable.
